JobDescription.org ("Site," "Services") is operated by THEFIT, Inc. ("Company," "we," "us," "our"). By accessing or using the Site, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, do not use the Site.

Content is produced with AI assistance under editorial review (see our methodology page).
2. Informational use only — not professional advice

If you send us feedback, suggestions, corrections, or ideas about the Site, you grant us a perpetual, royalty-free license to use them for any purpose without obligation to you. You warrant that such submissions are original to you and not confidential.
9. Third-party links and ads

We don't control those sites and are not responsible for their content, privacy practices, or accuracy. OR ITS OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR REPUTATIONAL HARM — ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS; IN THOSE PLACES, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
14. Indemnification
You agree to defend and indemnify THEFIT, Inc. and its officers, employees, agents, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, your violation of any third-party right, or any harmful act toward another user.
15. DMCA and copyright complaints
If you believe content on the Site infringes your copyright, send a notice with: (a) the work claimed to be infringed; (b) the URL of the allegedly infringing content; (c) your contact information; (d) a statement of good-faith belief; (e) a statement of accuracy under penalty of perjury; and (f) your physical or electronic signature. 16. Governing law
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law principles.
17. Dispute resolution
Informal negotiation first. Before initiating any formal proceeding, the parties agree to attempt to resolve any dispute informally for at least thirty (30) days. The notice period begins on written notice from one party to the other.
Binding individual arbitration. If informal negotiations fail, any dispute arising out of or relating to these Terms or the Site will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and, where applicable, the AAA Consumer Rules (available at adr.org). The arbitration will be held in Clark County, Nevada, or by video/phone/written submission at the arbitrator's discretion. Either party may bring a claim in small-claims court if it qualifies.
YOU UNDERSTAND THAT BY AGREEING TO ARBITRATION, YOU WAIVE THE RIGHT TO SUE IN COURT AND TO HAVE A JURY TRIAL.
Class action waiver. All disputes will be brought in an individual capacity only — not on a class-action, collective, or representative basis. The arbitrator may not consolidate claims or preside over any form of class proceeding.
Exceptions. The following are not subject to arbitration: (a) claims to enforce or protect intellectual property rights; (b) claims of unauthorized access or breach of security; (c) any party's right to seek injunctive relief in a court of competent jurisdiction.
Statute of limitations. Any dispute must be brought within one (1) year of the date the cause of action arose, except where applicable law prohibits a shorter limitation period than the state default.
Forum. If for any reason a dispute proceeds in court rather than arbitration, both parties consent to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada.
18. Electronic communications
By visiting the Site, sending us email, or otherwise communicating with us electronically, you consent to receive electronic communications from us. You agree that any agreements, notices, disclosures, or other communications we provide to you electronically (via email or postings on the Site) satisfy any legal requirement that such communications be in writing.
19. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, government action, labor disputes, power or telecommunications failures, internet outages, pandemics, or third-party service disruptions.
20. California residents

21. Miscellaneous
These Terms (together with the Privacy Policy and any other policies posted on the Site) constitute the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver of that provision. If any provision is held unenforceable, the remaining provisions remain in full effect. We may assign our rights and obligations under these Terms; you may not. These Terms will not be construed against either party by virtue of having drafted them. No partnership, joint venture, employment, or agency relationship is created by these Terms.
